Welcome to DECERLE.
In these Terms of Service, the words "we", "us" and "our" refer to DECERLE, a trading name of Don Collective.
We operate this website and online store, together with all related content, features, tools, products and services that form part of your shopping experience (collectively, the "Services").
Our online store is powered by Shopify, which provides the e-commerce technology that enables us to offer the Services to you.
These Terms of Service, together with the policies and other terms referred to within them (collectively, the "Terms"), set out the rights and responsibilities that apply when you access, browse or use our Services or purchase products from DECERLE.

Product measurements and sizing information are provided as a guide. Minor variations may occur between individual products or styles.
We may update product descriptions, specifications, availability and other product information where reasonably necessary.
We may also discontinue products or limit quantities available to a particular customer, location or jurisdiction.
Nothing in this section affects your statutory rights where a product is faulty, not as described or otherwise does not meet the standards required by applicable consumer law.
3. Orders
Placing an order with DECERLE constitutes an offer from you to purchase the products included in your order.
Receiving an automated order acknowledgement does not necessarily mean that we have accepted your order.
Your order is accepted when we confirm acceptance and payment has been successfully authorised or processed.
We reserve the right to refuse or cancel an order where reasonably necessary, including in circumstances involving:
- Suspected fraud or unauthorised payment
- Incorrect pricing or product information
- Product unavailability
- Technical errors
- Suspected misuse of our Services
- Orders placed for unauthorised commercial resale
If we need to decline, amend or cancel an order, we will make reasonable efforts to contact you using the contact information supplied during checkout.
Please check your order carefully before submitting it. Once an order has entered processing or fulfilment, we may not be able to change or cancel it.
Returns, refunds and exchanges are handled in accordance with our Refund Policy and your applicable statutory consumer rights.
Products purchased from DECERLE are intended primarily for personal or household use and not for unauthorised commercial resale.
4. Pricing and Payment
Product prices, discounts and promotional offers may change from time to time.
The price applicable to your purchase is the price displayed when you submit your order, subject to the correction of obvious pricing errors.
Your order confirmation will show the amount charged.
Prices displayed on our store include applicable taxes where required by law.
Any applicable delivery or handling charges will be shown separately before you complete your purchase.
Prices available through DECERLE may differ from prices available through third parties or other sales channels.
Promotional offers may be subject to additional terms and conditions. Where specific promotional terms conflict with these Terms in relation to that promotion, the promotional terms will apply.
You agree to provide accurate and up-to-date payment, billing and account information when placing an order.
By submitting payment information, you confirm that:
- The information provided is accurate and complete;
- You are authorised to use the selected payment method;
- Your payment provider is authorised to process the transaction; and
- You agree to pay the total amount displayed at checkout, including any applicable delivery charges and taxes.
5. Shipping and Delivery
We aim to process and deliver orders within the timeframes stated on our website and in our Shipping Policy.
Any delivery dates or timeframes provided are estimates unless we expressly state otherwise.
Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, severe weather, customs procedures, transport disruption or other unexpected events.
We will not be responsible for delays caused solely by circumstances outside our reasonable control where the law permits.
However, where you purchase as a consumer, the goods remain at our risk until they have been delivered to you or to a person you have nominated to receive them, subject to applicable consumer law.

The Services and the materials made available through them — including the DECERLE name, branding, logos, website design, text, graphics, photographs, product images, videos, audio, reviews and other content — are owned by or licensed to DECERLE, Don Collective or the relevant rights holder.
These materials may be protected by Dutch, UK and international intellectual property laws.
You may use our Services for your own lawful, personal and non-commercial purposes.
Unless expressly permitted by law or authorised by us in writing, you may not reproduce, copy, modify, distribute, republish, transmit, commercially exploit, publicly display or otherwise use protected material from our Services.

The DECERLE name, logo and associated branding may not be used in a manner that suggests affiliation, sponsorship or endorsement without our prior written permission.
The Shopify name, logo and related marks belong to Shopify or its respective affiliates.
Other trademarks and names appearing through our Services remain the property of their respective owners.
7. Third-Party Tools
Our Services may provide access to tools, applications or functionality supplied by third parties.
We do not necessarily control or monitor those third-party tools.
Where permitted by law, third-party tools may be provided on an "as is" and "as available" basis.

To the extent permitted by law, DECERLE is not responsible for losses arising solely from your independent use of third-party websites, products or services outside our control.
Any questions or complaints regarding a third-party service should generally be directed to the relevant third party.
9. Relationship with Shopify
DECERLE's online store is powered by Shopify, which provides the technology and infrastructure used to operate our Services.
However, purchases made through our store are transactions between you and DECERLE / Don Collective.
Shopify is not the seller of the products purchased directly from DECERLE.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for DECERLE's products or for claims arising solely from transactions between you and DECERLE.
Nothing in this section limits any rights you may have directly against DECERLE under applicable consumer law.
10. Privacy
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Because our store is hosted by Shopify, Shopify also processes certain information relating to your access to and use of our Services.
Information you provide may therefore be shared with Shopify and relevant service providers where necessary to provide the Services.
Some of those providers may operate in countries other than your own.
Our Privacy Policy explains in more detail how DECERLE, Shopify and relevant service providers may collect, process and share personal information and what privacy rights may apply to you.
11. Feedback and Submissions
If you voluntarily provide us with product reviews, comments, suggestions, ideas, photographs or other content ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that Feedback for purposes reasonably connected with operating, improving and promoting DECERLE.
Where required by law, this licence will be limited to the rights reasonably necessary for those purposes.
You confirm that:
- You own the Feedback or have the necessary permission to provide it;
- Your Feedback does not infringe another person's intellectual property, privacy or other rights;
- Any compensation or incentive connected with the Feedback has been appropriately disclosed where required; and

We take reasonable care in operating DECERLE and providing our Services.
However, we cannot guarantee that our website will always be available, uninterrupted, secure or free from technical errors.
Information provided through our website is intended for general information about our products and Services.
Nothing in these Terms excludes warranties, guarantees, conditions or statutory rights that cannot lawfully be excluded.
In particular, if you purchase products as a consumer, these Terms do not affect your mandatory rights relating to goods that are faulty, not as described, unsatisfactory or otherwise fail to meet applicable legal requirements.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence where such liability cannot lawfully be excluded;
- Fraud or fraudulent misrepresentation;
- Your mandatory statutory consumer rights; or
- Any other liability that cannot legally be excluded or limited.
To the extent permitted by applicable law, DECERLE and Don Collective will not be responsible for losses that were not reasonably foreseeable when the relevant contract was formed or that result from circumstances outside our reasonable control.
If you are using the Services as a consumer, we do not exclude liability for losses arising from our failure to comply with our legal obligations where such liability cannot lawfully be excluded.
Nothing in these Terms is intended to reduce the statutory protections available to UK consumers.
17. Indemnification
To the extent permitted by applicable law, if you use the Services for business purposes or engage in unlawful or unauthorised use of the Services, you agree to compensate DECERLE, Don Collective and relevant service providers for losses, liabilities and reasonable costs resulting directly from your material breach of these Terms, applicable law or third-party rights.
This provision does not limit or remove statutory rights available to consumers.
18. Severability
If any provision of these Terms is determined by a court or competent authority to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent permitted by law or treated as severed where necessary.
The remaining provisions will continue in full force and effect.
19. Waiver and Entire Agreement
If we do not immediately exercise or enforce a right available under these Terms, this does not mean that we have waived that right.
These Terms, together with the policies and other terms expressly incorporated into them, constitute the agreement between you and DECERLE regarding your use of the Services.
Nothing in this section excludes representations or rights that cannot lawfully be excluded.
20. Assignment
You may not transfer your contractual rights or obligations to another person where doing so would materially affect our rights without our prior written consent, except where applicable law gives you the right to do so.
We may transfer our rights or obligations under these Terms as part of a business transfer, restructuring or similar arrangement, provided that doing so does not reduce your mandatory consumer rights.
21. Governing Law
DECERLE is operated by Don Collective, established in the Netherlands.
These Terms and any agreements through which we provide our Services are therefore governed by the laws of the Netherlands, subject to applicable conflict-of-law rules and mandatory consumer protections.
If you are a consumer located in the United Kingdom, nothing in these Terms removes or limits the mandatory protections available to you under UK consumer law.
You may also be entitled to bring proceedings in the courts available to you under applicable consumer law.
Nothing in this section is intended to prevent a consumer from relying on mandatory rights available under the laws of their country of residence.

Section headings are included for convenience and readability only.
They do not affect the interpretation of these Terms.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices, legal obligations or regulatory requirements.
The latest version will always be made available through our website.
Where required by law, we will provide appropriate notice of material changes.
Changes will take effect from the date specified in the updated Terms or accompanying notice.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those changes to the extent permitted by law.
